1. Introduction and Legal Agreement
These Terms of Service (the "Terms") form a legally binding agreement between you and Anthony D, carrying on business as Bespoke Learning (the "Institute", "Bespoke Learning", "we", "us", or "our").
By accessing our website, creating an account, booking a session, purchasing a package or subscription, or using any Bespoke Learning service, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, you must not use our services.

You have the express right to receive these Terms in French.
By clicking "I Agree" or by continuing to use our services, you expressly request that all documents, services, and communications related to your account be provided in English.

Video recording is an optional enhancement to Bespoke Learning's core audio transcription service.
- •Illinois Residents: Video recording involves collection of biometric identifiers (facial geometry) and requires separate consent under BIPA.
- •Students Under 13: Parent or legal guardian must consent to video recording.
2. Capacity and Eligibility
You must be at least the age of majority in your jurisdiction of residence (18 or 19 years old, as applicable) and have the legal capacity to enter into a binding agreement to use our services.
If you are under the age of majority, a parent or legal guardian must create the account, review and accept these Terms, and remain responsible for all use of the services by the minor.
Students Under 13

Students 13-17
- • May create accounts with parental awareness
- • Parent can access via Parent Portal

Students 18+
- • Full independent account control

3. Services Overview
Bespoke Learning provides educational and mentoring services, including:
- One-to-one IB and AP tutoring
- Group tutoring and exam preparation
- Theory of Knowledge (TOK) and Extended Essay support
- Study skills and academic coaching
- French and English language support
- AI-enhanced learning tools and feedback
Important: The Institute provides mentorship, coaching, and instructional support. We do not guarantee specific results, grades, test scores, or admission outcomes. Student progress depends on the student's own effort, attendance, engagement, and completion of independent work.
4. Academic Integrity
We support students in building independent skills.
You agree that you will not request, encourage, or permit any tutor or AI tool associated with Bespoke Learning to:
- Complete graded homework or assignments on your behalf
- Write essays, Internal Assessments, Extended Essays, or similar tasks for submission in your name
- Sit exams, tests, or assessments on your behalf, including online assessments
If we reasonably believe that our services are being used for academic dishonesty or impersonation, we may suspend or terminate services immediately. No refund or credit will be provided in that case.
5. User Accounts and Responsibilities
To access our services, you may be required to create an account on our platform or third-party platforms. You agree to:
- Provide accurate, current, and complete information
- Keep login credentials confidential and secure
- Notify us promptly if you suspect unauthorised access to your account
You are responsible for all activities carried out through your account, whether by you, your child, or any person using your credentials.
6. Third-Party Platforms and Tools
To deliver our services, we use third-party platforms and service providers, including:
Scheduling & Management
Our booking system, Wise.live
Video Conferencing
Zoom, Google Meet, Microsoft Teams, Wise.live
Payment Processing
Stripe, PayPal, Wise
AI Tools
Various third-party AI platforms and education tools
Security & Fraud Prevention
Google reCAPTCHA v3 protects our forms from bots and abuse. reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.
Maps, Address Entry, and Autofill
Certain forms may use Google Maps/Places services (including address lookup and autofill). Google may receive device and usage data to perform these lookups subject to its privacy policy.
Your use of these third-party platforms may also be governed by their own terms and privacy policies. We do not control these platforms and are not responsible for outages, data incidents, or technical failures solely attributable to those providers.
7. Data Collection and Use
Information We Collect
- Personal Information: Contact details, account credentials, educational information, payment information
- Session Data: Audio recordings, video recordings (optional), AI-generated transcripts, tutor notes
- Technical Information: Device and browser information, IP address, Portal usage patterns
- Learning Support Information: Voluntarily disclosed learning disabilities or accommodations (treated as sensitive data)
How We Use Your Information
- Service Delivery: Provide tutoring sessions, generate AI transcripts, track progress
- AI Processing: Google Gemini for transcription, OpenAI for learning reports, Flint for practice
- Communications: Booking confirmations, progress reports, support requests
Your Data Rights
You have the right to access, correct, request deletion, withdraw consent, object to certain processing, export your data, and lodge complaints with supervisory authorities.

8. Booking, Scheduling and Cancellations
All lessons must be scheduled through the designated student portal or through any other scheduling system specified by us in writing.
Student Cancellations
You must provide at least 24 hours' notice through the student portal to cancel or reschedule a session.
- • For package holders: One session credit is deducted for late cancellations
- • For pay per lesson clients: The full lesson fee remains payable
Lateness Policy
Tutors will wait up to 15 minutes for a student to join. If you arrive more than 15 minutes after the scheduled start time, the session is forfeited and one session credit is deducted.
9. Fees, Payments, Subscriptions and Refunds
Currency Notice
All transactions are processed in Canadian Dollars (CAD). Prices displayed in other currencies are for reference only. Your bank may apply its own exchange rate and fees.
Subscription Commitment Period
Academic Subscriptions require a commitment through the end of the academic year:
- • September through March: Subscription runs through May 31st of that academic year
- • April onwards: Includes remainder of current year plus entire following academic year
First Session Guarantee
If, after your first scheduled session, you feel the tutor match is not right, you may cancel your Academic Subscription within 48 hours without an Early Termination Fee. You will be charged only for that single session at the À La Carte rate.

10. Lesson Credits, Expiry and Transfers
December Purchase Rule
Any tutoring package purchased after the first Friday of December will have credits that become active on January 1st of the following year.
Credit Validity and Expiry
- • Standard prepaid lesson credits are valid for 3 months from the date of purchase
- • Credits that are not used within this period expire automatically and have no cash value
- • Credits are non-transferable and non-assignable without our prior written consent
We are under no obligation to reinstate or extend expired credits, except where required by applicable law.
11. Promotional Offers and Referral Programmes
From time to time, we may offer limited-time promotions or discounted packages. Each promotion is subject to specific terms described in the related materials.
Referral Programme
- • A referring client receives one free 30-minute lesson credit per successful referral
- • A "successful referral" is a new student who completes at least one paid session
- • Maximum of 10 referrals per academic year may be credited to a single referrer
Self-referrals, fake accounts, or any form of abuse of the referral programme will result in withdrawal of referral credits.
12. Intellectual Property and Content Use
All lesson materials, worksheets, slide decks, videos, AI prompts, code, and other content provided or created by Bespoke Learning or its tutors (the "Materials") are protected by copyright and other intellectual property laws.
You receive a limited, non-exclusive, non-transferable licence to use the Materials for personal, non-commercial study purposes only.
AI-Generated Content
- Session Transcripts: Provided for your personal educational use. You may not republish, distribute, or commercialize transcripts without written permission.
- Learning Reports: AI-generated progress reports are for your personal use. Reports remain our intellectual property but you have unlimited personal use rights.
- Session Recordings: You own your words and image in recordings. We retain license to process recordings for service delivery.
13. Recordings, Screenshots and Reviews
To protect the privacy and safety of students and tutors:
- You must not record, screenshot, or otherwise capture audio or video of any lesson without the express written consent of the tutor and the Institute
- You must not post recordings of lessons or portions of lessons on any public platform without written consent
We may record sessions for quality assurance, safeguarding, or training purposes. Where required by law, we will notify you before recording.
14. Use of AI and Digital Tools
We use third-party AI and digital tools to support learning, create practice questions, provide formative feedback, and model thinking.
AI Limitations
AI-generated content has inherent limitations. It may contain inaccuracies, omissions, or bias. AI tools do not replace professional judgement, teacher assessment, or examination criteria.
By using our services, you acknowledge that AI outputs are advisory and educational in nature. You remain responsible for reviewing and verifying any AI-generated content before using or submitting it.
15. Accessibility and Accommodations
Bespoke Learning aims to provide services that are inclusive and accessible.
We work towards compliance with recognised web accessibility standards, including WCAG 2.2 AA, as far as reasonably practicable for a small organisation.
If you require accommodations due to disability or learning needs, please contact us in writing and describe the support you require. We will review your request and confirm which accommodations we can reasonably provide.
16. Minors, Safeguarding and COPPA
For students who are minors in their jurisdiction:
- A parent or legal guardian must provide consent for lesson enrolment
- The parent or guardian remains responsible for supervising the minor's use of online tools
- We recommend that an adult is available during online sessions for younger students
COPPA Compliance (US)
For users located in the United States, we collect and process personal information about children in compliance with the Children's Online Privacy Protection Act (COPPA), including obtaining verifiable parental consent before collecting personal information from children under 13.
17. Technical Requirements and Service Continuity
You are responsible for providing and maintaining:
- A suitable device, such as a computer or tablet
- A stable internet connection
- A functioning microphone, speakers or headset, and camera
- An up-to-date browser and operating system
If a lesson is disrupted or cannot proceed due to your device or connection issues, the session may still be treated as delivered.
18. Data Protection and Privacy
We take privacy seriously. We collect, use, and disclose personal information in accordance with our Privacy Policy, which forms part of these Terms.
We handle personal information in accordance with applicable Canadian law, including PIPEDA, as well as GDPR for EU/UK users, and CCPA for California residents.
Data Retention
We generally retain student records and associated personal information for 24 months after the last meaningful activity, unless a longer retention period is required by law.
You may request access to, correction of, or deletion of your personal information in accordance with our Privacy Policy.
19. Acceptable Use, Misconduct and Termination
You agree that you will not:
- Harass, threaten, or abuse tutors, staff, or other students
- Use hate speech or discriminatory language
- Engage in fraud, impersonation, or any unlawful activity
- Attempt to bypass security or misuse the platform
We may suspend or terminate your access if we reasonably believe you have violated these Terms. If terminated due to misconduct, no refund or credit will be provided.
20. Disclaimers and Limitation of Liability
To the fullest extent permitted by applicable law, the services are provided "as is" and "as available".
We do not warrant that:
- The services will meet every expectation or requirement
- The services will be uninterrupted, secure, or error-free
- Specific academic, examination, or admission outcomes will be achieved
Maximum Liability: Our total aggregate liability for any claim is limited to the total amount of fees you have paid to us in the 3 months immediately preceding the event giving rise to the claim.
21. Indemnification
You agree to indemnify, defend, and hold harmless Bespoke Learning, its owner, contractors, and agents from and against any claims, demands, losses, damages, costs, or expenses arising out of or relating to:
- Your breach of these Terms
- Your misuse of the services
- Any content or information you provide
- Any violation of another person's rights
22. Force Majeure
We are not responsible for any failure or delay in performance caused by events beyond our reasonable control.
This includes natural disasters, war, strikes, labour disputes, civil unrest, public health emergencies, power outages, failures of third-party service providers, or changes in law or regulation.
23. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them are governed by the laws of the Province of Ontario and the federal laws of Canada.
You agree that any legal action or proceeding will be brought exclusively in the courts of Toronto, Ontario, Canada.
If you are a consumer residing in a jurisdiction with mandatory consumer protection laws that cannot be varied by contract, those laws will apply to the extent they are mandatory and prevail over any conflicting provision.
24. Regional Disclosures
To the extent required and applicable, Bespoke Learning:
- Adheres to Canadian privacy and consumer protection laws, including PIPEDA
- Respects EU and UK consumer protection and data protection frameworks (GDPR)
- Complies with US regulations including FTC guidance and COPPA
- Respects data protection principles in Hong Kong (PDPO) and Singapore (PDPA)
- Respects UAE consumer protection measures
25. Communications and Notices
You agree that we may send important notices and information to you by email, through the student portal, or by other reasonable electronic means.
You are responsible for:
- Providing an accurate and regularly monitored email address
- Checking the portal and your email for updates and notices
26. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page.
If changes are material, we will provide notice through the website, the portal, or by email. Continued use of the services after changes take effect will constitute your acceptance of the revised Terms.
27. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
