Portal Access Guidelines
Rules and responsibilities for using the Bespoke Learning Portal.

Important Beta Notice
The Portal is currently in beta version. This means:
- The Portal may experience bugs, errors, or temporary unavailability
- Features may change, be removed, or have limited functionality
- Performance may vary and may not be optimal
- We do not guarantee uninterrupted or error-free access
- There is a risk of data loss or service interruption
By using the Portal, you accept these beta limitations.

Alternative access: Email us to book sessions or access services through alternative methods if the Portal is unavailable.
Beta exit: We will notify users when the Portal moves to stable release with 30 days to review updated terms.
1. Overview
These Portal Terms govern your use of the Bespoke Learning Student Portal and Parent Portal (the "Portal"). These terms supplement our general Terms of Service.
By accessing the Portal, you agree to these Portal Terms and our general Terms of Service.
If you do not agree, do not use the Portal.
2. Portal Access
2.1 Who Can Access
Student Portal
Students with active accounts and valid login credentials.
Parent Portal
Parents with active accounts linked to one or more student accounts.
Account status: Access requires account in good standing with current payment status.
2.2 Your Security Responsibilities
You must:
- Keep login credentials confidential
- Use secure passwords meeting our requirements
- Not share credentials with anyone (including family members)
- Log out when using shared or public devices
- Notify us immediately if you suspect unauthorized access
You are responsible for all activities under your account. We may suspend access if we detect suspicious activity.
2.3 Age Requirements
Under 13
Parent or guardian must create and manage the account.
Ages 13-17
May use Student Portal with parental oversight.
18+ (Age of Majority)
Can request independent account status.
3. Student Portal
3.1 Available Features
- Dashboard (sessions, credits, progress)
- Book sessions with available tutors
- Access learning materials and courses
- View family account information
- Purchase credits and packages
- Manage profile and settings
- View schedule and session history
- Access progress reports
3.2 Booking Sessions
Requirements:
- • Sufficient credits for selected session duration (40 or 55 minutes)
- • Correct timezone setting in your profile
- • Acceptance of cancellation policy (24-hour notice required)
Process:
- • Availability shown in real-time based on tutor schedules
- • Booking confirmed after successful credit deduction
- • You receive confirmation email with session details
Your responsibility: Ensure timezone is correct. Missed sessions due to timezone errors are subject to standard cancellation policy.
3.3 Credit Management
- Separate wallets for 40-minute and 55-minute sessions
- Credits expire based on package type (see purchase confirmation)
- View balance, transaction history, and expiry dates in dashboard
- Credits are non-transferable without written authorization
- Expired credits cannot be reinstated except where required by law
3.4 Student Responsibilities
You agree to:
- Use Portal only for legitimate educational purposes
- Provide accurate information when booking or updating profile
- Respect scheduled session times and cancellation policies
- Follow academic integrity guidelines for learning materials
- Not manipulate, hack, or interfere with Portal functionality
4. Parent Portal
4.1 Available Features
- Dashboard for all linked children
- View and manage sessions and credits
- Access billing and payment history
- Purchase credits and packages
- View progress reports
- Manage family account settings
4.2 Linked Accounts
How linking works:
- • Parent accounts link to one or more student accounts
- • Linking requires verification from both parent and student (if 18+)
- • Parents view but cannot directly modify student settings without authorization
- • Contact support to modify or remove account linking
4.3 Parent Responsibilities
You agree to:
- Use Portal only to manage your children's tutoring services
- Act in the best interests of your child
- Supervise minor children's use of Student Portal as appropriate
- Maintain accurate contact and billing information
- Notify us of changes to family relationships or custody
5. Privacy and Data
Portal usage is governed by our Privacy Policy. We collect and process data necessary for Portal functionality and service delivery.
5.2 Who Sees What
Students see:
Their own data and family account information
Parents see:
Their own data and data for linked children
Tutors see:
Student name, age/grade, learning goals, session history, progress notes. Cannot see billing or family details.
Staff see:
Data necessary for account management and service delivery
5.5 Session Recording and AI Processing
For complete details on AI-powered learning features, data collection, and your rights, see Terms of Service Sections 1.2, 1.3, and 7.
Core Service (Audio)
- • Audio transcription is part of the core Bespoke Learning service
- • Sessions are audio recorded and transcribed using Zoom's built-in transcription and/or Google Gemini AI
- • Transcripts analyzed by OpenAI ChatGPT for learning reports
- • Audio files deleted within 48 hours after transcription
- • Transcripts retained for duration of service plus 12 months
Optional Feature (Video)
- • Video recording is optional and can be enabled in Portal settings
- • Videos retained for duration of service plus 12 months
- • You can disable video recording at any time
Consent
- • By using the Portal and accepting Terms, you consent to audio recording and AI processing
- • Illinois residents: Additional voiceprint/facial geometry consent under BIPA required
- • Students under 13: Verifiable parental consent required under COPPA
6. Acceptable Use
6.1 Permitted Activities
You may use the Portal to:
- Access and manage your tutoring account
- Schedule and manage sessions
- View learning materials and resources
- Track progress and view reports
- Manage billing and payments
6.2 Prohibited Activities
You must not:
- Violate any laws or regulations
- Infringe intellectual property rights
- Transmit viruses, malware, or harmful code
- Attempt unauthorized access to other accounts or systems
- Interfere with or disrupt Portal functionality
- Use automated tools or bots without authorization
- Harass, threaten, or abuse others
- Share login credentials
Consequences: Violations may result in warning, temporary suspension, or permanent termination depending on severity.
7. Learning Materials
7.1 Usage Rights
Learning materials and resources in the Portal are for personal, non-commercial educational use only.
You may not:
- • Copy, distribute, or share Portal content without written permission
- • Resell or commercialize materials
- • Remove copyright notices or attributions
7.2 Your Content
If you submit content (messages, feedback, assignments): You retain ownership but grant us a non-exclusive, royalty-free, worldwide license to use, store, and display your content solely for providing Bespoke Learning services.
This license ends when you delete content or close your account, except for content shared with tutors for educational purposes.
8. Technical Requirements

JavaScript and cookies must be enabled
Portal is accessible on mobile devices through responsive design. Some features may have limited functionality on mobile.
9. Service Availability
Beta status: As stated above, the Portal may experience more frequent interruptions during beta.
We strive to maintain Portal availability but do not guarantee uninterrupted access.
Reasons for unavailability:
- • Scheduled maintenance (advance notice when possible)
- • Beta updates and improvements
- • Technical issues or system failures
- • Security incidents
- • Third-party service disruptions
We may update, modify, or discontinue Portal features at any time. We will provide notice of material changes through the Portal or by email.
10. Support

Response time: We aim to respond within 2 business days.
11. Account Termination
11.1 Termination by You
You may stop using the Portal at any time. Termination does not affect obligations under general Terms of Service. Outstanding credits and services remain subject to general Terms.
11.2 Termination by Us
We may suspend or terminate Portal access if you:
- • Violate these Portal Terms or general Terms of Service
- • Engage in fraudulent, abusive, or illegal activity
- • Fail to pay amounts due
- • Present security concerns
- • As required by law
11.3 Effect of Termination
Upon termination:
- • Portal access immediately revoked
- • You cannot access Portal features or data
- • Outstanding obligations (including payments) remain
- • We retain data for 90 days then permanently delete it, except where required by law
12. Intellectual Property
The Portal, including design, functionality, and content, is owned by Bespoke Learning. Trademarks, logos, and branding are our property.
You may not use our intellectual property without written permission.
You retain ownership of content you create. By using the Portal, you grant us the license described in Section 7.2.
13. Liability Limitations
The Portal is provided "as is" and "as available" in beta version.
- • We do not warrant error-free or uninterrupted Portal access
- • Portal may contain bugs, errors, or incomplete features
- • Features may not work as expected
- • We are not liable for loss or damage from Portal use or unavailability
You use the Portal at your own risk during beta.
This does not limit our liability for:
- • Gross negligence or willful misconduct
- • Data breaches caused by failure to implement reasonable security
- • Violations of applicable consumer protection laws
- • Death or personal injury caused by our negligence
Maximum Liability: Where permitted by law, our total liability is limited to fees you paid in the 90 days before the claim.
14. Dispute Resolution
Report Portal-specific issues to support first. We will work in good faith to resolve them.
Unresolved disputes are subject to dispute resolution procedures in our general Terms of Service.
Governing Law
Default: These Portal Terms are governed by Ontario law (Canada). Disputes are subject to courts in Toronto, Ontario.
Exceptions: See Regional Provisions below for jurisdiction-specific provisions (Switzerland, European Union, United Kingdom).
15. Changes to These Terms
We may update these Portal Terms from time to time. The "Last Updated" date indicates when terms were last revised.
Material changes will be communicated through Portal announcement or email.
Continued Portal use after changes constitutes acceptance of updated terms. If you do not agree to updated terms, stop using the Portal.

17. Relationship to General Terms
These Portal Terms supplement and form part of our general Terms of Service.
In case of conflict between Portal Terms and general Terms, Portal Terms govern Portal-specific matters.
These Portal Terms, our general Terms of Service, Privacy Policy, and Refund Policy constitute the complete agreement regarding Portal use.
Appendix: Jurisdiction-Specific Provisions
CHSwitzerland-Specific Provisions
These provisions apply to users accessing the Portal from Switzerland or subject to Swiss law.
Swiss Data Protection (FADP)
You have the right to access, rectify, request deletion, object to processing, request data portability, and lodge complaints with FDPIC.
14-Day Withdrawal Right
Swiss consumers have 14-day withdrawal right under Swiss Code of Obligations. Email hello@bespokelearning.io within 14 days to withdraw.
Swiss Courts
Swiss users may bring claims in Swiss courts. Small claims (under CHF 30,000) may be brought in Swiss consumer courts.
EUEuropean Union-Specific Provisions
These provisions apply to users in EU member states.
GDPR Compliance
EU users' data is subject to the General Data Protection Regulation (GDPR). You have rights of access, rectification, erasure, restriction, portability, objection, and rights related to automated decision-making.
14-Day Withdrawal Right
EU users have 14 days to withdraw from distance contracts under EU Consumer Rights Directive.
EU Dispute Resolution
ODR Platform: https://ec.europa.eu/consumers/odr
EU users may bring claims in courts of their EU member state.
UKUnited Kingdom-Specific Provisions
These provisions apply to users in the United Kingdom.
UK Data Protection
UK users' data is subject to UK GDPR and Data Protection Act 2018.

14-Day Cancellation Right
UK users have 14 days cancellation rights under Consumer Contracts Regulations 2013.
UK Courts
UK users may bring claims in UK courts.
Other Jurisdictions
For users in jurisdictions not specifically addressed above:
- • Local consumer protection laws apply where they provide greater protection
- • You have rights under your local data protection laws
- • We make reasonable efforts to comply with local legal requirements
